1. Acceptance of Terms
By accessing or using CertifiedDraw (the "Platform"), you agree to these Terms & Conditions ("Terms"), our Privacy Policy, and our Cookie Policy.
These Terms constitute a legally binding agreement between you (or the organisation you represent) and CertifiedDraw Ltd ("we", "us", "our"). You confirm that you are at least 18 years of age and, if acting on behalf of an organisation, that you have authority to bind that organisation to these Terms.
2. Platform Description
CertifiedDraw is an independent draw adjudication and certification platform. The Platform enables operators to:
- Conduct certified random draws with cryptographically verifiable outcomes
- Generate tamper-evident draw certificates
- Provide public verification of draw results
- Maintain auditable records for compliance and dispute-resolution purposes
CertifiedDraw acts as an independent adjudicator. We do not own, control, or benefit from any prize, competition, or promotion operated by our users.
3. Accounts & Registration
To use the Platform you must register an account. You agree to:
- Provide accurate, current, and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorised access or security breach
- Accept responsibility for all activity conducted under your account
We reserve the right to suspend or terminate accounts that we reasonably believe are being used fraudulently or in breach of these Terms.
4. Acceptable Use
You may use the Platform only for lawful purposes and in accordance with these Terms. You must not:
- Use the Platform to operate unlawful lotteries, gambling, or prize promotions without the required legal authority
- Attempt to manipulate, reverse-engineer, or tamper with any draw, certificate, or verification mechanism
- Upload or transmit malicious code, spam, or unauthorised automated queries
- Impersonate CertifiedDraw or any other person or entity
- Use the Platform in any manner that could damage our reputation or mislead third parties
Misuse of the Platform for fraudulent draws or misleading promotions may result in immediate account suspension and referral to the appropriate regulatory authorities.
5. Draw Conduct & Integrity
CertifiedDraw provides the technical infrastructure for draw adjudication. As the draw operator, you are solely responsible for:
- Ensuring your promotion complies with all applicable laws and regulations in your jurisdiction
- Obtaining any required permits or licences before running a promotion
- Providing accurate entrant data and draw parameters
- Communicating draw terms and outcomes honestly to entrants
Once a draw is sealed and certified, no modification of the entrant list, draw parameters, or outcome is possible. CertifiedDraw does not accept requests to alter sealed draw records under any circumstances.
6. Certificates & Verification
Certificates issued by CertifiedDraw are cryptographically sealed records of draw outcomes. They are provided for verification and audit purposes only.
CertifiedDraw certificates do not constitute legal proof of prize entitlement or any other legal right. They record the draw outcome as conducted on the Platform at a specific point in time.
Public verification records are retained for a minimum of five (5) years from the date of the draw.
7. Fees & Payment
Certain Platform features are available on a paid subscription or per-draw basis. Details of current fees are available on our Pricing page. By subscribing or purchasing a draw credit, you authorise us to charge the applicable fees to your payment method.
All fees are quoted exclusive of VAT unless stated otherwise. We reserve the right to change our pricing with at least 30 days' notice for existing subscribers.
Refunds are assessed on a case-by-case basis in accordance with applicable consumer protection law. Please contact us at Contact for refund enquiries.
8. Intellectual Property
All Platform technology, design, software, and content — including the CertifiedDraw brand, certificates, and verification infrastructure — are the intellectual property of CertifiedDraw Ltd or its licensors.
You retain ownership of the data you upload (entrant lists, draw descriptions, etc.). By using the Platform you grant us a limited licence to process that data solely to provide the services described in these Terms.
You must not reproduce, distribute, or create derivative works from Platform content without our prior written consent.
9. Limitation of Liability
To the fullest extent permitted by law, CertifiedDraw shall not be liable for:
- Any indirect, incidental, special, or consequential loss arising from use of the Platform
- Loss of revenue, profits, or business arising from Platform downtime or unavailability
- Regulatory penalties or fines arising from your failure to comply with applicable law
- Third-party claims arising from draw outcomes or promotion conduct
Our total aggregate liability to you in any 12-month period shall not exceed the total fees paid by you to us during that period.
Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, death, or personal injury caused by negligence.
10. Platform Reliability & Execution Disclaimer
CertifiedDraw's platform is engineered to the highest standards of accuracy, security, and reliability. Our certified draw engine uses cryptographically verified random number generation and maintains a comprehensive audit trail for every execution.
However, like all software-based services, the platform operates within an environment that includes factors beyond our direct control. In rare circumstances, draw execution may be affected by:
- Software anomalies — unexpected errors or edge cases within application logic
- Infrastructure interruptions — server-side failures, hosting outages, or cloud provider incidents
- Network disruptions — connectivity issues affecting data transmission between your device and our servers
- Browser incompatibilities — limitations or errors within the web browser used to access the platform
- Uploaded data errors — incorrectly structured, corrupted, or misconfigured entry files provided by the user
- User configuration mistakes — draw settings that do not accurately reflect the intended draw parameters
- File integrity issues — corrupted or malformed files that cannot be reliably processed
No software system — including certified or adjudicated platforms — can unconditionally guarantee 100% uptime or the complete absence of technical errors. By proceeding with a draw execution, you acknowledge this and confirm that the draw configuration, entry data, and settings submitted are accurate and complete to the best of your knowledge.
It is the sole responsibility of the user to ensure that all entry data, draw settings, and configuration are correct prior to execution. CertifiedDraw accepts no liability for outcomes resulting from inaccurate data, misconfigured settings, interrupted execution, or any external technical conditions outside our reasonable control. In the event of a failed or interrupted execution, it is the user's responsibility to review, correct, and re-submit as appropriate.
11. Termination
You may terminate your account at any time via your account settings. We may suspend or terminate your account with immediate effect if we reasonably believe you have breached these Terms or applicable law.
Upon termination, your right to access the Platform ceases immediately. Draw certificates and verification records associated with completed draws remain accessible to the public for the retention period specified in section 6.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless you are a consumer resident in another jurisdiction where mandatory consumer protection law provides otherwise.
