Promotional competitions in New Zealand are regulated by the Gambling Act 2003 and the Fair Trading Act 1986. Free-to-enter prize draws are generally exempt from gambling licensing, but promoters must ensure their competition qualifies as a lawful free-entry promotion.

Gambling Act 2003
Prize draws that do not require purchase or payment to enter are generally not classified as gambling under the Gambling Act. A free entry route must be available with equal prominence to any paid option.
Fair Trading Act 1986
Promotional terms must be truthful and not misleading. Prizes must match what was advertised. Winners must be selected and notified in accordance with published rules.
Privacy Act 2020
Collection of entrant personal data is governed by the Privacy Act 2020 and the Information Privacy Principles (IPPs). A privacy notice must accompany any data collection.

What NZ Promotion Organisers Must Do

Organisers running prize draws or competitions in New Zealand must ensure their promotion meets the requirements of the Gambling Act and Fair Trading Act. CertifiedDraw's role is limited to certifying the draw outcome — all legal and regulatory obligations remain with the organising entity.

Published Terms & Conditions
Full T&Cs must be published before the promotion opens — including prize details, entry mechanic, closing date, draw date, and how winners will be selected and notified.
Free Entry Route
A free means of entry must be available to avoid classification as a lottery under the Gambling Act. The free entry route must be made equally accessible to all entrants.
Fair & Random Selection
Winners must be selected using a method that is genuinely random. The selection process must align with what is described in the T&Cs.
Prize Delivery
Prizes must be delivered as advertised within a reasonable timeframe. Substitutions require winner consent unless the T&Cs explicitly provide for this.
Under-18 Promotions
Promotions targeting minors require additional safeguards, and prize types should not include alcohol, gambling products, or other age-restricted goods.
