Trade Promotion Lotteries & State Permit Requirements

Promotional competitions in Australia are classified as either 'games of chance' (prize draws) or 'games of skill' (competitions). Trade promotion lotteries — where the element of chance determines the winner — require permits in certain states and territories.

State & Territory Permits
South Australia, Australian Capital Territory, and Northern Territory generally require a permit to conduct a trade promotion lottery. NSW, VIC, QLD, WA, and TAS have moved to a permit-free or notification model subject to conditions.
Australian Consumer Law
Under the ACL, promotional terms must be clear, fair, and not misleading. Prizes must match what was advertised, and winners must be drawn and notified within the stated timeframe.
Privacy Act 1988
Collection of entrant personal information is governed by the Privacy Act 1988 and the Australian Privacy Principles (APPs). A privacy notice must accompany data collection.

What Australian Promotion Organisers Must Do

Published Terms & Conditions
Full T&Cs must be published before the promotion opens, including prize values, entry mechanic, draw date, eligibility, and how winners will be notified.
State Permit Applications
Where required (SA, ACT, NT), a permit must be obtained before the promotion launches. Permit numbers must be displayed in promotional materials.
Draw Supervision
Some states require draws to be conducted under supervision or by an independent third party — CertifiedDraw's certified draw process supports this requirement.
Prize Fulfilment
Prizes must be awarded as described. Substitutions may only be offered with the winner's consent. Unclaimed prizes may require notification to relevant state authorities.
Winner Publication
In most states, winner names and postcodes must be published after the draw in accordance with the permit conditions or T&Cs.
